EARN AVIOS WITH AREAS!

1. ORGANIZING COMPANY, CALENDAR, GEOGRAPHY, AND PARTICIPANTS

ÁREAS, S.A.U., with registered offices at  C/ Gaspar Fàbregas i Roses, 81, planta 2ª, 08950, Esplugues de Llobregat, Barcelona, registered in the Barcelona Commercial Registry and with tax identification number A08225013 (hereinafter “Areas“), will carry out a nationwide promotion, under the modality of “DIRECT GIFT,” aimed at any person over the age of 18 who makes purchases at any of the hospitality establishments in Spanish airports listed in Appendix I (the “Establishments“). The Promotion (the “Promotion”) begins on January 13, 2023 and will last as long as the promotion is valid and published on the  https://promocionavios.areas.com/website (the “Promotional Period”).

2. OBJECT

The objective of the Promotion is to promote the sale of products offered in the Establishments by Areas. 

3. PRIZE

For purchases over SIX (6) EUROS in the Establishments that have advertised the promotion “Earn Avios here!” customers will get a total of TWO (2) AVIOS (right to redeem for services from any of the present or future companies participating in the AVIOS Iberia Plus and/or Vueling Club Programs and managed by Avios Group (AGL) Limited (hereinafter, “AGL“) for every EURO spent in the chosen program, either Iberia Plus or Vueling Club (but not both) (hereinafter, “Loyalty Programs“). 

3.1. Prize terms and conditions:

Before making the payment, to earn the Avios the user must present the QR code that identifies him/her as a member of the Loyalty Program to which he/she wants to assign the Avios. In this way, the Avios generated with the purchase will be charged directly and automatically to the user’s account in the Loyalty Program they have chosen, and under no circumstances can Avios derived from the same purchase or transaction be accumulated in the two Loyalty Programs . 

Each customer will be entitled to 2 Avios for each euro spent for purchases over €6, so customers will receive a minimum of 12 Avios per transaction or none will be allocated. If the purchase amount has decimal values, the system will round to the nearest whole number. 

Smart Travelers customers (Areas’ loyalty club) who wish to take advantage of the benefits of this program and also earn Avios must notify us before paying and show the QRs that accredit them as a member of both programs. 

Loyalty Program customers who do not have the app on their devices or for any other reason cannot display their QR code should follow the steps explained in the previous point. 

Areas is not responsible for any incorrect Avios allocation if the QR shown is not the buyer’s. 

Areas reserves the right to verify both the authenticity of the Loyalty Program account and the transaction.

The Avios will only be allocated to the account of the customer making the transaction and Areas reserves the right to confirm the ownership of the account shown by the customer. The customer agrees to comply with this condition, otherwise Areas may cancel the allocation of Avios, without this giving the customer any right to future claims. 

Avios will be issued and redeemed in accordance with the terms and conditions of the Loyalty Programs. The use of the Avios earned in this promotion is also subject to the terms and conditions of the Loyalty Programs. The user’s information within the Avios and Loyalty Programs is AGL’s responsibility, so the user must resolve any error or claim that may arise due to an error or inconsistency with AGL directly through its channels and complying with its corresponding terms and conditions.

The customer must ask AGL directly for any transfer, assignment or any other type of transaction with the Avios granted by Areas, according to its own procedures, through its channels and in compliance with its terms and conditions. In no event shall Areas be liable for any transaction, use or loss of said Avios. 

Areas does not accept requests for Avios in cash. 

The time Avios are valid for is established in the Loyalty Program. In no case will Areas be liable for their expiration or any procedure regarding their validity or the value assigned to them to be redeemed under each Loyalty Program. 

If the customer were to return a purchase through which the customer had obtained Avios, those Avios would be deducted from the customer’s Loyalty Program account and any subsequent transaction would have to be recorded by means of a new receipt.

The customer can read through the list of establishments where Avios can be earned at  https://promocionavios.areas.com/. The customer understands and accepts that, depending on the business situation at any given time, Areas may change the Establishments, without this giving the customer any right to any claim, so the customer acknowledges that he/she should read through these legal rules on a frequent basis. 

As long as they meet the requirements, the same person can get Avios in more than one transaction. 

4. HOW TO PARTICIPATE

To participate in the Earn Avios here! promotion, in addition to meeting the requirements of the clause above, the customer must:

1. Spend at least €6 at one of the establishments; and

2. Let the cashier know that they want to earn Avios and show them the QR of their loyalty program card.

If for any reason the Avios cannot be charged to the Avios account the customer chose, the customer may request it by sending an email to promocionavios@areas.com with a picture of the receipt and their user data (either the QR code or the frequent flyer number of the loyalty program of their choice). Those Avios will be added to the customer’s account within a maximum of 15 business days. Areas reserves the right to verify the authenticity of that information, as well as the fact that no Avios have been previously charged for the same transaction, in which case Areas shall have the right to deny the allocation of Avios.

5. FRAUD

If Areas or any company professionally associated with the Promotion detects any anomaly or suspects that a participant is preventing the normal course of the promotion or illegally altering their allocation or participation through any technical or computer manipulation to falsify their engagement, they may unilaterally remove that participant’s allocation of Avios. 

To this effect, Areas has put in place the necessary technological support to detect any possible fraudulent, anomalous, or malicious action aimed at altering participation in the Promotion to attain the prize unlawfully. 

Area reserves the right to remove any participant from the promotion, and consequently any Avios assigned to them, who demonstrates or is suspected of having any irregular behavior in this regard.

6. CLAIMING AND/OR REDEEMING PRIZES 

If Avios were not automatically assigned at the time of the transaction, the customer will have a maximum of 15 calendar days to make the request explained in clause four. 

The customer may not request the allocation of any Avios after the end of the promotion.

Failure by the customer to comply with the above will be understood as a waiver of the prize and will not entitle the customer to any indemnity or compensation.

7. ACCEPTANCE OF RULES

By participating in the Promotion, you agree to these rules ( https://promocionavios.areas.com/) and Areas’ discretion regarding the resolution of any issue that may arise from the Promotion.

Areas reserves the right to make any changes, clarifications, or corrections to these rules and to suspend or extend the Promotion at any time it deems appropriate, always making the changes public and after any administrative communications that may be required have been made.

8. DATA PROCESSING

In accordance with what is provided for in Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and Spanish Organic Law 3/2018, of December 5, on Personal Data Protection and Guarantee of Digital Rights, Areas hereby informs you that the personal data of the participants in the Promotion will be processed automatically to carry out the Promotion.

You hereby state and ensure that all the personal data you supply to Areas is true and matches your identity. 

The data of users who have earned Avios at its establishments as a result of their participation in this promotion may be shared with third parties to whom Areas is legally or contractually obliged to communicate them.

The customer may at any time exercise his/her rights of access, rectification, deletion and opposition, portability, and limitation of processing as set out in the applicable regulations by emailing his/her request to gdpr-contact@areas.com, indicating in the subject line: “Data Protection.” You may also file a complaint with the competent data protection authority.

9. CHANGES TO THE RULES 

Areas reserves the right to shorten, extend, modify, or cancel this Promotion at any time, communicating that circumstance in a way that prevents any harm coming to any of the participants.

10. LIABILITY 

Areas will not be held liable for delays, losses, or deteriorations for causes which are not attributable to it. 

Areas shall also not be liable in the case of force majeure (such as strikes, etc.) which may impede the winner from enjoying their prize in part or in its entirety. 

Areas waives liability if any of the cases mentioned above occur, as well as any liability for damage that may arise during use of the prize.

Areas waives liability for any damages of any kind that may be due to the temporary lack of availability or continuity of the operation of the app linked to the Loyalty Program or the integration system that scans the QR code and automatically assigns Avios through which the customer participates in the Promotion, for disappointment in the use users may have attributed to it, and for any errors in access to that platform.

Areas reserves the right to eliminate from the Promotion and for good cause any user who defrauds, alters, or disables the proper functioning and normal and legal course of the Promotion. 

11. LIMITATIONS ON PARTICIPATION

Areas employees and their parents, children, or relatives up to the second degree may not participate in the promotion. People under 18 are also bared from participation.

12. APPLICABLE LEGISLATION

These rules of participation are governed by Spanish law. Any dispute, discrepancy, question, or claim resulting from their performance or interpretation will be settled by the courts of Barcelona, waiving any other possible jurisdiction.

The terms and conditions of the Promotion will be available to anyone who wishes to consult them at  https://promocionavios.areas.com/.
